Terms of Service

These terms are an agreement between you and Gula Labs, LLC ("Gula Labs", "we", "us"), a New York limited liability company. They cover bryangula.com and every app and website Gula Labs publishes, including Bitfinder (the iOS app and bitfinder.app), Otto, ClaudeDeck and Blue Olive (together, the "Services"). By using any of the Services you agree to these terms. If you don't agree, please don't use them.

1. Who can use the Services

You must be at least 13 years old to create an account. If you are under 18, a parent or guardian must agree to these terms on your behalf.

2. Accounts

Some Services let you create an account, usually with a passkey instead of a password. You're responsible for the devices and credentials used to sign in and for everything done through your account. Tell us at bryan@bryangula.com if you think your account has been used without your permission. You can delete your account at any time from the app or by emailing us.

3. Purchases and subscriptions

Some Services offer paid features as one-time purchases or auto-renewing subscriptions. Every price is shown in US dollars before you buy.

• In the iOS apps, purchases are made through Apple's App Store and are governed by Apple's terms. Apple bills you, manages renewals and handles refunds. Manage or cancel subscriptions in your Apple ID settings.
• On the web, purchases are billed by card through Stripe, our payment processor. Subscriptions renew automatically at the listed price until you cancel. You can cancel at any time from your account's billing page or by emailing us, and you keep access until the end of the period you've paid for.
• Price changes. We'll give you at least 30 days' notice before a price increase affects an existing subscription, and you can cancel before it takes effect.
• Delivery. Everything we sell is digital. Access is granted immediately after a successful purchase.

Refunds are covered by our Refund Policy.

4. Your content

Some Services let you post content: comments, clips, reactions, ratings, photos and similar. You keep ownership of what you post. You give Gula Labs a worldwide, royalty-free licence to host, display and distribute that content inside the Services so the features work (for example, showing your comment to other listeners). You're responsible for what you post. Don't post anything illegal, harassing, hateful, sexually explicit, infringing, spam, or that reveals someone else's private information. We may remove content or suspend accounts that break these rules.

5. Podcasts and other third-party content

Bitfinder helps you find and talk about podcasts. Podcast audio, artwork and show notes belong to their creators and are streamed from the creators' own public feeds, or hosted only with the creator's written permission. Gula Labs does not claim ownership of any podcast. If you're a rights holder and want a show removed or changed, email bryan@bryangula.com and we'll act promptly.

6. Acceptable use

Don't use the Services to break the law, to harm or harass anyone, or to interfere with the Services or other people's use of them. Don't scrape the Services, work around free-tier limits or paid features, probe or attack our systems, or reverse-engineer the apps except where the law expressly allows it.

7. Our intellectual property

The Services themselves, including the code, design, names and logos, belong to Gula Labs or its licensors. We grant you a personal, non-transferable licence to use the apps as intended. No other rights are granted.

8. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We don't promise the Services will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, Gula Labs won't be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill arising from the Services. Our total liability for any claim relating to the Services is limited to the greater of $50 or the amount you paid us in the 12 months before the claim. Some jurisdictions don't allow these limits, so some of them may not apply to you.

10. Termination

You can stop using the Services at any time. We may suspend or end your access if you break these terms. Sections that by their nature should survive, including the licence to content you've already shared, the disclaimers, the limitation of liability and the governing-law clause, survive termination.

11. Governing law

New York law governs these terms, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in New York County, New York, and you consent to their jurisdiction. If you're a consumer somewhere whose law gives you additional rights, those rights still apply.

12. Changes to these terms

We may update these terms. For material changes we'll post the new version here with a new effective date and, where we can, tell you in the app or by email. Continuing to use the Services after a change means you accept it.
